Sri Lanka is a constitutional, multiparty republic. President Mahinda Rajapaksa, who was reelected to a second six-year term in January , and the parliament, which was elected in April , share constitutional power. The government is dominated by the president's family; two of the president's brothers hold key executive branch posts as defense secretary and minister of economic development, while a third brother is the speaker of parliament. A large number of other relatives, including the president's son, also serve in important political or diplomatic positions. Independent observers generally characterized the presidential and parliamentary elections as problematic. Both elections were fraught with violations of the election law by all major parties and were influenced by the governing coalition's massive use of state resources.

Freedom of the press in Sri Lanka is guaranteed by Article 14 1 a of the Constitution of Sri Lanka which gives every citizen "the freedom of speech and expression including publication". Although the constitution guarantees free speech it places significant limits on the exercise of this right. Much of the media in Sri Lanka is state-owned. There are no regulations in place to guarantee editorial independence, instead the state-owned media takes a heavy pro-government stance. Although there is a large contingent of independently owned media in Sri Lanka, most practice self-censorship. The civil war ended in May but many of the war time laws and regulations remain in place. The attacks on the media have reduced but journalists continue to be harassed and intimidated.

There was continued impunity for violations committed during the internal armed conflict, and the government failed to uphold commitments to the UN Human Rights Council around justice and reconciliation. As such, justice stalled and impunity prevailed, including in cases of killings and other violations allegedly linked to the ruling Rajapaksa family. Human rights defenders, journalists, lawyers and criminal investigators were increasingly intimidated and harassed. There were reports of deaths in custody and extrajudicial executions. Violence against women remained widespread.
